System Use Case Split

Hi All

I find myself in the unique environment where until I came along our companies system Use cases have been written by developers. To be honest they have done a fairly good job.

There is however an existing solution in place for our customer with a 3 tier architecture.
To complicate matters our involvement in the development process comes from the point at which the message is sent from the 1st tier to the second.

The way the use cases have been split is to therefore have the first use case in a transaction starting from the point the message is sent from the first tier to the second and then the response from the second. this is all this UC will cover.

The Second Use Case for the transaction covers the interaction between the 2nd and 3rd tiers only.

They have put in no includes relationship between the two use cases which there at least should be.

Is it even correct to structure use cases this close to the architecture. AQny use cases I have written in the past have completely ignored any existing architecture but focus on achieving the goal of the original Actor for the most part.

I am in a position to change everything if I want to I am just not sure if I should change this part.

What are your thoughts on the way they have structured things?????
